COPPA Consent Information
Parent or Legal Guardian ConsentBefore a child younger than 13 years of age may use Swish-Hoop Apps and certain Swish-Hoop websites, the Company requires consent from the Child's parent or legal guardian. Contact information for the parent or legal guardian should be entered during the registration process for a new user (Applicant) under the age of 13. US law requires that we seek permission from parents or guardians before utilizing any personal information for anything other than determining the Applicant's age and contacting the parent or guardian and the Applicant for the sole purpose of obtaining parental/guardian permission. All aspects of the App or software are disabled until we receive such permission. There are three levels of permission that may be granted: Limited (Internal) Use, Full (Public) Use and No Use. If a parent or guardian chooses to only grant Internal Use of the information, then we will only use the information described below for communication with parents or guardians and the Applicant and not the public; however, the functionality of the software will be fairly limited, as the Applicant's name and other information cannot appear to others. If parents or guardians grant Public Use, then others may be able to see a limited subset of the supplied information. If parents or guardians grant No Use, then all information will be removed from our records and the Applicant will not be able to use the App or software. Please see below:
Limited Use Category Permission
This information will only be used within the Company and for communication with the user and the parent or guardian. It may include the following: a picture of the user, the name of the user, the user name of the user, the user's birth date/age, the user's basketball shooting statistics and achievements, videos uploaded by the user, the user's geolocation, country and postal code and the user's height. The user may not have any team, group or friend affiliations, nor participate in any leaderboards, as his/her name may not be shared to others. To grant permission for Internal Use of information, simply reply to the email that was sent to the parent or guardian when the Applicant registered (without changing the subject line) with a "Yes" as the first line in the body of the email.
Full Use Category PermissionThis permission includes the Limited Use Category Permission above for internal use, plus the following public assess of information: a picture of the user, the name of the user, the user name of the user, the user's team, group and friend affiliations and information, the user's basketball shooting statistics and achievements, posted videos from the user, and messages from and to the user. Although not directly accessible by the public, it might be possible for others to infer the user's country and postal code and the user's age through the grouping of the user into certain geographical regions and age groups.
To grant permission for Full Use of information, please print this document. Sign where indicated, then email a photograph, fax a copy or send a hardcopy of the signed form by post back to the company as described in the attached document.
